Man struggling after Atwater shooting

A 27-year-old man was shot and wounded over the weekend at a residence on Fifth Street, police reported Monday.

The incident was reported about 10:30 p.m. Sunday and the victim is expected to survive, according to Lt. Samuel Joseph.

The victim was a passenger in a green car driven by a 28-year-old man. They told police they were getting gas at a Valero station on Olive Avenue. The driver realized he'd forgotten his cell phone, so they drove back to the residence, north of Atwater Boulevard, to retrieve it.

While driving, they said they noticed a blue Honda Accord following them. The pair pulled into the driveway of the home, police said, and the driver got out to get his phone.

The Accord also pulled into the driveway. Police said a Latino male got out and began shouting obscenities while walking toward the victim, who was seated in the passenger seat of the green car; the gunman then started firing.

The driver of the green vehicle got back into the car and tried to flee the area, police said, crashing into a parked car before making it to a Circle K store on Atwater Boulevard.

Police were called, and the victim was flown to a Modesto hospital, where he remains in critical condition. Joseph said it's unclear why shots were fired at the two men. He said neither of the men had gang connections known to law enforcement.
