Senate candidate Heidi Fuller has refiled a lawsuit that attempts to bar Assemblyman Tom Berryhill from running against her on the grounds that he has not lived in Senate District 14 long enough to campaign for that office.
She wants the secretary of state to enforce a clause in the state constitution that requires candidates to live in a district a year before Election Day.
Berryhill moved into the district a month ago, which would give him 11 months in the district by November.
The 3rd District Court of Appeal this week declined to hear the case. Fuller on Friday resubmitted it to Sacramento County Superior Court.
