The Modesto City Council will consider the following agenda items Tuesday:
An amendment to the city ordinance regarding massage establishments. In September, the state started a voluntary permitting program for massage therapists. As a result, local agencies are barred from regulating businesses participating in the state program. The city could lose as much as $9,300 in fees collected each year from massage businesses.
Consider a request from SunBlest Valley Market to hold a farmers market on 10th Street, between H and I streets. The market could use the street each Saturday from May through November, resulting in a street closure from 6 a.m. to 2 p.m. those days.
Consider extending a deferral of capital facility fees for residential permits for an additional year. It allows developers to delay paying the fees until occupancy permits are issued for new homes. Since the policy went into effect in January 2009, the city has issued 21 building permits for homes; the deferral option was exercised on four permits.

Consider submitting a grant application to the Federal Transit Administration for $4.5 million for the bus maintenance facility.
The City Council meets at 5:30 p.m. Tuesday in the basement chambers of Tenth Street Place, at 1010 10th St.
