Aug. 29 trial date set for Merced homicide case

An Aug. 29 trial date has been set for Carlos Castillo, a defendant in the homicide of Charles Johnson, a 52-year old Merced man.

Castillo and Marcos Garibay are accused of shooting Johnson in the head and chest around midnight July 30 in the 1100 block of Childs Avenue. He died at a hospital later that afternoon. Garibay and Castillo, both 18 at the time, were arrested the same day.

Castillo and Garibay have pleaded not guilty to first-degree murder charges.

A trial setting date for Garibay has been set for June 7.

Mishya Singh, Castillo's defense attorney, said she couldn't elaborate on the case. "They are still investigating and finding info," Singh said. "We are just beginning the discovery phase."

Garibay's attorney Hayden Smith was unavailable for comment.

Both men remain at the Merced County Jail in lieu of $1 million bail.
