Pitman High teacher accused in teen sex case appears in court

The Pitman High School math teacher accused of having sex with a 17-year-old student appeared at a preliminary hearing today in Stanislaus County Superior Court.

Carl Kubicek is charged with four felony counts of unlawful sexual intercourse. The complaint says the incidents occurred in a classroom at Pitman High, in the girl's home, at the home of one of her relatives and in a home she was watching while the owner was away.

Kubicek also faces one felony count of oral copulation and one misdemeanor count of exploitation of a minor, which suggests photographs or video was taken.

Kubicek’s attorney Frank Carson made a motion to see three CDs and an audio cassette tape pertaining to the case, likely interviews recorded by investigators.

Kubicek is due back in court June 5.

Former Turlock police officer Jorge Cruz also is accused of having an unlawful sexual relationship with the same girl. His case is being handled separately.
