Modesto police say man shot at Five Points has long criminal record

Modesto police today said the man shot by an officer at the Five Points intersection has "an extensive criminal and mental health history."

Police said Officer Kalani Souza, a 5-year law enforcement veteran, fired his duty weapon multiple times, striking Michael Salgardo, 40, of Modesto. He is recovering from multiple gunshot wounds to his lower body at a hospital, police said.

Detectives believe Salgardo was under the influence of an alcoholic beverage at the time of the incident Thursday evening in front of the Jack in the Box restaurant at the junction of McHenry Avenue and J Street.

Police and the Stanislaus County District Attorney's Office are investigating the incident. No charges have been filed, police said, although they may be filed later.

Souza has not been interviewed yet and is on paid administrative leave while the investigation continues.

Detectives recovered what appeared to be a pellet or BB pistol from the sidewalk where the confrontation occurred. Police said the pistol is strikingly similar to a real handgun. A police news release said Souza gave Salgardo verbal commands before the shooting, but no details were given.

The incident began in front of Suzie's Adult Superstore on McHenry Avenue. Salgardo approached another man in front of the store and apparently tried to sell him a gun, police said.

The second man didn't buy the gun but called police. Officers responded and found a man matching the description given by the caller in front of the Jack in the Box.

The incident was the third officer-involved shooting by a Modesto police officer in two weeks and the fifth this year.
