Stanislaus Wrongful death trial date set

A March 2012 jury trial has been scheduled in a wrongful death lawsuit brought by the family of Craig Prescott, who died after an April 2009 struggle with jailers.

Prescott, 38, of Modesto was booked at the Stanislaus County Jail on suspicion of stalking and threatening his wife and was described in court documents as "severely mentally ill." Stanislaus County sheriff's deputies used pepper spray, "Tasers and clubs in a brutal effort to subdue him" while forcing him from a cell, documents say.

Prescott's family says his death "was caused by failure to provide adequately for his psychiatric needs and use of unreasonable force." The lawsuit was filed in federal court.

A Nov. 4 order signed by U.S. District Court Judge Oliver Wanger scheduled a trial starting March 6, 2012, in Fresno.

It's expected to last up to 10 days.
